Stone Clear GmbH, Industriestrasse 63, 6034 Inwil, Switzerland · UID CHE-109.482.634 · info@stoneclear.ch · +41 41 790 38 05
1. Scope
- These T&C apply to all orders placed via the online shop www.stoneclear.ch between Stone Clear GmbH (“StoneClear”) and its customers.
- “Consumers” are natural persons ordering for private purposes. “Business customers” order for their professional or commercial activity. Unless stated otherwise, the rules apply to both.
- Customers' deviating terms only apply if StoneClear confirms them in writing.
- On-site services (cleaning, restoration) are provided by Steinpflege AG under its own terms; they are not covered by these T&C.
2. Offer and conclusion of contract
- The presentation of products in the shop does not constitute a binding offer.
- By clicking “Pay now” or “Complete order”, the customer submits a binding offer.
- The contract is concluded with the order confirmation by e-mail. The confirmation lists the products ordered, prices and shipping costs.
- Images and colour shades may differ slightly from the original. Technical data (coverage, dwell time, etc.) are guide values; the respective product data sheet is authoritative.
3. Prices, VOC levy and discounts
- All prices are in Swiss francs (CHF) and, for consumers, include statutory VAT, plus shipping costs.
- For products containing volatile organic compounds (VOC), the Swiss Confederation charges an incentive levy. It is automatically added to the cart as a separate line item “VOC levy” and is included in the total order amount.
- Discount codes are only valid under the conditions stated for the code (e.g. first order only), cannot be combined and cannot be redeemed for cash.
- For deliveries outside Switzerland, customs duties and import charges of the destination country may apply. These are borne by the customer.
4. Payment
- Payment can be made using the payment methods shown at checkout.
- Business customers may order on invoice by arrangement; payment term 10 days net.
- In the event of late payment, StoneClear may charge default interest of 5 % per year (Art. 104 CO) and reasonable reminder fees.
- The goods remain the property of StoneClear until paid in full.
5. Delivery and shipping
- StoneClear delivers to Switzerland and Liechtenstein. Deliveries to other countries, in particular Germany, are possible by arrangement; shipping costs will be communicated in advance. Shipping costs depend on weight and are shown on the Shipping costs page and at checkout.
- Orders are usually dispatched within 1–2 working days (DPD or freight forwarder). Delivery times are guide values. If an order cannot be delivered within 30 days, the customer may withdraw from the contract; payments already made will be refunded.
- Collection in Inwil is possible by prior appointment.
- Consumers: risk passes upon handover of the goods to them. Business customers: upon handover to the carrier.
- Please report visible transport damage immediately and hidden damage within 5 days to info@stoneclear.ch (with a photo). Consumers' statutory rights remain reserved.
6. Returns
- Unopened, unused goods in their original packaging can be returned within 30 days of receipt. Details are set out in the returns and refund policy.
- For safety and hygiene reasons, opened or partly used cleaning, care and sealing products are excluded from the voluntary return option.
- Consumers resident in the EU also have a statutory 14-day right of withdrawal (see right of withdrawal). It is not affected by this voluntary return rule.
7. Warranty
- Consumers: the warranty for new goods is 2 years from delivery (Art. 210 CO). In the event of defects, StoneClear may, at its discretion, repair, replace, reduce the price or refund it; mandatory statutory rights remain reserved.
- Business customers: the warranty is 1 year from delivery and is limited to repair or replacement.
- There is no warranty for normal wear and tear, consumables (e.g. pads, brushes, mop covers) or damage caused by improper use, failure to follow the instructions for use or product data sheet, third-party interference or unsuitable surfaces.
- Stone surfaces react differently. Before applying to a whole area, test the product in an inconspicuous spot.
- Defective equipment must be sent to StoneClear with a copy of the invoice and a short description of the fault, or brought in by arrangement.
8. Liability
- StoneClear is liable without limitation for intent and gross negligence, for personal injury and under the Product Liability Act.
- Otherwise, liability is limited – to the extent permitted by law – to the order value; StoneClear is not liable to business customers for indirect and consequential damage (e.g. loss of working time).
9. Data protection
The processing of personal data is governed by the privacy policy.
10. Applicable law and place of jurisdiction
- Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
- The place of jurisdiction for business customers is Inwil (canton of Lucerne). Consumers may sue at their place of residence or at StoneClear's registered office.
- Consumers resident in the EU retain the protection of the mandatory provisions of their country of residence.
11. Final provisions
Should any provision be invalid, the remaining provisions remain valid. The version published at the time of the order applies.
